These are many of the rules and regulations of the community. You may also download and view our covenants and by-laws. Any violation of these rules may result in having your privileges revoked and/or a fine. Any fine that is not paid may result in having a lien put on your property.
The HOA Enforcement & Fine Policy:
Upon notification or observance of a violation, the HOA or its representative will send out a notice citing the actual violation and a reasonable time period in which to correct the violation. Upon the second notification or observation of the continued violation following the expiration of the time period allotted, a fee of $25 per day will be assessed until the violation is corrected.
If an area is locked and you enter it, than you are considered TRESPASSING and you WILL be Prosecuted.

- Garbage can must be kept in garage or in the back of your house.
- Homeowners are required to submit plans for any and all exterior improvements to the Architectural Committee prior to installation for approval.

Landscape:
- Residents must keep your grass cut.
- Lawn edging must be done along driveway and sidewalk.
- Must use weed control on your lawn.
- Hedges & shrubs must be kept trimmed.
- Grass clippings must be swept up after cutting grass.
- Those residents who have pets, MUST clean up after them.
Neighborhood Watch:
- There is no soliciting in our community without the written permission from our HOA Board. View Fairburn Code on solicitation

- The Curfew for those 17 & under is Sunday through Thursday from 11:00pm - 6:00am. Friday and Saturday from 12:01am - 6:00am.

Pool Rules and Restrictions:
- You Must have a Pool Pass to enter the pool. To get a pool pass, you must be current on your HOA dues. Click here to request your pool pass.
- The pool is for the exclusive use of residents and their guests. Residents are responsible for the supervision and conduct of their guests.
- All residents and guests must sign in at the pool entrance and may bring up to (2) guests to the pool.
- All children under the age of 16 must be accompanied by an adult resident and supervised at all times by the adult resident.
- Alcoholic Beverages are not permitted in the pool area during pool hours.
- Smoking is not permitted at any time within the clubhouse or pool area.
- Showers are required before entering the pool. No tanning oil is allowed in the pool (it collects filth and gums up the filtering system).
- No running, pushing, scuffing, splashing or rough play is permitted in the pool area.
- Glass containers of any kind are prohibited in the pool area.
- Swimming suits only in the pool. No cut-offs, tee shirts or street clothing allowed.
- Any use of profanity, vulgar, sexually or racially offensive language will result in immediate ejection from the pool for the rest of the day.
- Voices shall be kept at normal conversational levels. All music will be radio version, no profanity.
- In case of thunder and threatening weather, the pool must be cleared immediately.
- Spot checks will be performed to insure rules are being followed.
- All violations of the pool rules should be reported to the Association at 770-306-0128. Violations of pool rules may result in suspension of pool privileges.
Enforcement of Rules
- First offense will result in a warning.
- The second offense will result in a ten (10) minute suspension (out of pool, seated with the pool monitor).
- The third offense will result in a 24 hour suspension from the pool.
- Any child asked to leave the pool more than twice in a season will not be allowed to return to the pool for the rest of the season.

Clubhouse Rules & Regulations:
- You must be current on your HOA dues to rent clubhouse.
- The clubhouse has a maximum capacity of thirty (30) people. No gathering may exceed this number of guests.
- No alcoholic beverages may be consumed or served in or around the clubhouse.
- The Clubhouse has a No Smoking policy. Renters will not be permitted to smoke inside the Clubhouse.
- No tape of any kind should be placed on the walls.
- No balloons should be hung from the ceiling fan.
- Thumb tacks may be utilized for your decorations.
- Clubhouse must be restored to its original appearance.
- Clubhouse inspections will be conducted with the reserving homeowner both before and after the event.

Cancellation Policy
- Clubhouse rental must be canceled one week prior to the event in order to receive a 100% refund of your $150 rental fee.
- Cancellations made up to 72 hours of the event will receive 50% refund of the rental fee.
- Cancellations less than 72 hours of the event are nonrefundable.
Cleaning Charge
The charges listed above are average prices only. If a higher cleaning cost or repair is needed, Renter will be responsible for all final costs and the $150.00 deposit will be automatically forfeited.
- Mop kitchen floor - $10.00
- Mop bathroom floors - $10.00 each
- Empty/clean refrigerator - $35.00
- Clean the oven/stove - $35.00
- Empty garbage containers - $20.00
- Remove tape from walls - $50.00
- Return furniture to original position - $30.00
- Clean Clubhouse patio/pick-up trash - $25.00
- Extra cleaning in bathrooms - $30.00

Tennis Court Rules & Regulations:
- Hours are from 7:00am to 10:00pm
- The tennis courts are for the exclusive use of residents and their guests and residents are responsible for the conduct of their guests.
- No one under 16 is allowed without adult supervision.
- No alcoholic beverages, smoking, glass bottles or food is permitted on the tennis court. Only drinks in plastic containers allowed.
- Only tennis equipment can be used on the tennis courts. No basketballs, footballs, baseballs, frisbees, skate boards, roller blades or strollers permitted.
- If another resident arrives to use the tennis courts while you are playing, you should release it to them after 1 hour of play.
- Always ensure the lights are turned off and the gate locked prior to leaving the court.
- All violations of the tennis court rules should be reported immediately to the HOA and may result in suspension of tennis court privileges.
- Absolutely no horse play, puching, scuffing, sitting or leaning on the net is permitted.
- No loud music or profanity, music should be radio version only.
- All areas should be traash free upon leacing the court.
- Play at your own risk.
Playground Rules & Regulations:
- Play at your own risk.
- This Playground is for elementary age children ONLY.
- Open from dawn to dusk.
- No loitering in the playground area.
- Equipment should not be used when it's wet, as doing so can lead to slips and falls.
- Always sit in the swing; don't stand or kneel. Hold on tightly with both hands. Stop the swing completely before getting off.
- No jumping out of swings, no twisting or swinging sideways.
- Stay a safe distance from other children on swings, being careful not to run or walk in front or in back of moving swings.
- When using the slide, go down one at a time in the sitting position, feet forward. Wait until the person starts down the slide before climbing the ladder.
- No glass bottles, food or gum allowed.
- No alchoholic beverages are permitted.
- Plastic water bottles are permitted
- No horse play allowed.
- Don't wear clothes with drawstrings at the playground. They can get caught on equipment and pose a strangulation hazard.
- If you notice broken equipment, Please report it to a member of the HOA or playground committee.
- This is NOT a public playground and is for the sole use of The Parks at Durham Lake residents and their guests.
